Coaching Confidentiality Agreement (Scotland)

This Agreement is made on the date you confirm your appointment between:

  1. Rachel Tulloch, (“the Coach”)

  2. You (“the Client”)

1. Purpose

The purpose of this Agreement is to ensure that all personal, professional, and sensitive information shared during coaching sessions and online course sessions and materials remains confidential.

2. Definition of Confidential Information

For the purposes of this Agreement, “Confidential Information” means any information disclosed by either party during coaching sessions, whether spoken, written, or recorded, including but not limited to:

  • Personal experiences, goals, and challenges

  • Business or professional information (including course content and discussions)

  • Coaching or course session notes or recordings

3. Obligations of the Coach

The Coach agrees to:

  • Keep all Confidential Information private and secure

  • Not disclose Confidential Information to any third party without the Client’s written consent, except where required by law or where there is a risk of harm to the Client or others

4. Obligations of the Client

The Client agrees to respect the privacy of the Coach and not disclose any personal or proprietary information about the Coach without consent. In addition the Client will not disclose, share or download content from the online courses. Where possible the coach has made some of the online content downloadable. This is the only course content that should be removed from the online platform.

5. Exceptions

Confidentiality may be broken if:

  • Required by a court order or legal obligation under the Law of Scotland

  • There is a reasonable belief of risk of harm to self or others

6. Duration

This Agreement remains in effect for 7 years after the conclusion of the coaching relationship.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the Law of Scotland, and any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.

8. Signatures

By agreeing to accept your appointment and undertaking coaching calls with the Coach, you are hereby acknowledging that you have read this agreement and abide by it.
